INTRODUCTION
The Exampact mobile application (the “Application” or the “app”) was developed by Exampact Consult Limited (“We”) as a Commercial App that assists pupils or students in primary and secondary schools in learning. It also assists them to prepare adequately for both internal and external examinations by providing qualitative and quantitative educational contents. We are using this policy notice to inform users of this app about our policies regarding collection, processing, use and disclosure of personal information while using the app. By downloading or using the app, the terms stated herein will automatically apply to you. Therefore, make sure that you read them carefully before using the app.
INFORMATION COLLECTED
For a great user experience with the app, certain basic personal information will be collected from a supervising parent, guardian or teacher, who is the main authorized/authenticated user and owner of the device(s) from which the pupils or students will be accessing the contents. This information collected serves also to authenticate and identify each parent or guardian or teacher. Therefore, this app assumes that a parent, guardian or teacher, who is at least 18 years old is supervising every child, student, pupil or minors using this app as a study tool. The personal information is collected upon sign-up. The supervising parent, guardian or teacher is expected to register their students or children in the app. These students or children are the eventual users of the app for the sole purpose of learning and examination mastery. The app is specifically tailored for students and pupils between the ages of 5 and 18 but under the strict supervision of their parents, guardians or teachers who are entirely responsible for what the students/children do with the phones or any other device through which they access the services provided by the app. By downloading and installing this app to consume our service, you warrant that if you are a minor, that you have obtained the permission of your parents, guardians or teacher before using the Exampact app. If you are a parent, guardian or teacher, by downloading and using exampact, you have agreed that Exampact will not be held responsible for any incident resulting from allowing your phone or any device to be used by your registered minors, children or students who use such device to access the contents of the app.
From a supervising parent/guardian or teacher, we’ll collect name, email address, phone number, location (in future) and profile photo from google account sign-in. These are purely for authentication and identification of one parent from another. This information is protected and never shared with any third parties. A supervising parent or teacher registering a child or student(s) to use the app, is expected to give us the following personal data of the student(s): name, date of birth, class in school, 4-digit access PIN code, gender and optionally, a profile image. Again, this data is collected for identifying each student and to provide the content applicable or relevant to each student based on their age and class in school. Needless to say, this information is never shared with any third parties.
When students take exams on the app, we process and store their performance scores. These scores are available to both parents and teachers and for each student in their individual profile screens scoreboard. The app also generates customized certificates which the app uses as a means of encouraging student users to complete multiple subject exams and encourage hard work. The scoreboard information is vital to the students and their parents as a feedback of their performance. Again, this information is not shared with third parties, but the app has a provision made for the students/parents to share their exam completion certificates online via social media platforms. This action is entirely at the discretion of the parents supervising their child(ren) using the app. By using this app, you have agreed that such features are available and can be used by your children or students using the app.
SECURITY
The Exampact application stores and processes the personal data provided to us for the app to perform its function. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Exampact app won’t work properly or at all. We have gone to great lengths to ensure the app only performs what it is rightly intended to do by deploying the app on trusted third-party servers with cutting edge security features.
FURTHERMORE
You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Exampact Consult Limited.
Exampact Consult Limited is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
You should be aware that there are certain things that Exampact Consult Limited will not take responsibility for. Certain functions of the app will require the app to have an active internet connection, albeit very minimally. The connection can be Wi-Fi, or provided by your mobile network provider, but Exampact Consult Limited cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left. If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Exampact Consult Limited cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Exampact Consult Limited cannot accept responsibility.
UPDATES
At some point, we may wish to update the app. The app is currently available on Android and the requirements for Android (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Exampact Consult Limited does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
POLICY CHANGES
We may update this Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Policy on on this page. This policy is effective as of 3rd October, 2022.
